Send a high quality whisky as a beautiful gift! Put this present package into your cart and we will pack your bottles as a gift. If you choose bottles with a normal square packages, we can pack 1-2 bottles into this gift package. (We find a special solution for over sized or round whisky packages.) Of course this will be the inner package and there will be another protecting transport box for the delivery.

You can also add a short personal text to your gift, which you can write into the remarks box in the checkout. A different shipping address can also be chosen in the checkout, in addition to the billing address. Please leave us another note in the remarks box, if you wish us not to include an invoice into the parcel. We will then send you the invoice separately by email.

The recipient will receive a beautifully packed high quality Scotch with your personal message. A valuable and stylish gift that you can be sure will be appreciated!

Payment Methods

Here we inform you about the payment methods of the Whisky4you web shop. If you have any questions or suggestions, please feel free to contact us!

Payment in advance and payment after shipment

We accept your order by sending you a declaration of acceptance in a separate email within two days, in which we may also provide you with our bank details. We kindly ask you to enter your order number when paying, otherwise your payment cannot be assigned. If the order number is missing with the payment, there could be delays in delivery, which we want to avoid and for which we unfortunately cannot accept any responsibility.

When we have received your payment, we will either deliver the goods directly to you or notify you when they are available for collection, depending on the delivery address and the corresponding information in your order.

Credit card , SOFORT and Giropay – processing via STRIPE / Woocommerce

 When ordering, you can choose another payment method offered there, such as a credit card, SOFORT transfer, Giropay, etc. There you will be asked to enter your payment details.

These payments are processed through the financial service provider Stripe / Woocommerce.

You simply enter your data in the payment form and legitimize yourself for the payment method.

The data required for payment is exchanged with your financial services company. After Stripe/Woocommerce has authenticated you as the cardholder, your financial services company will be prompted to initiate the payment process.

You will then immediately receive our order confirmation.

Delivery will be made within 1-3 days once your payment has been credited to our account.

We would like to point out that payment via SOFORT transfer unfortunately does not work “immediately”, but usually takes a few days, which can delay delivery. The payment methods by credit card or Giropay, on the other hand, usually arrive within one working day.

Cash on pickup / Prepayment and pick up

 You can choose to pay cash on pickup at your order. For this option, please click on “Direct bank transfer“ and write into the notes in the order form that you would like to pick up the goods and pay cash on pickup.

We accept your order by sending a declaration of acceptance in separate e-mail within two days, which is the closing of the contract.

After that we will agree by email together about a pickup date and the goods will be prepared for you to that date in our shop.

If you wish you can also pay in advance and then come or send somebody for the pickup. In this case, please choose “Direct bank transfer“ and write into the information field in the order form, that you wish to pick up the goods and pay in advance. In case of “Prepayment and pick up“ we ask you also to write the name and birthday of the person who will pick up the goods. (Please consider that this person must be minimum 18 years old.)

We accept your order by sending a declaration of acceptance in separate e-mail within two days, which is the closing of the contract.

At the pickup we will ask for a document to check the person you have defined in your order to make sure that we give your goods into the right hands.

Purchase on invoice

 A purchase on account is only possible with an existing customer relationship after several purchases and a successful credit check. If you meet these criteria, please email us a separate application for evaluation to: info@whisky4you.net .

If you have been accepted for purchase on account, select “Purchase on account” in the checkout and send your order. You will then immediately receive the order confirmation with which we accept your order.

You are then obliged to pay or transfer the amount specified on the invoice within 7 days of receipt of the invoice. Payment is due without deduction from the invoice date. After the payment period set by the calendar has expired, you will be in arrears even without a reminder. A right of retention by you that is not based on the same contractual relationship is excluded. Offsetting against other claims is excluded unless these are undisputed or stipulated by law.

We ask for your understanding that we reserve the right to take back our acceptance for “payment on account after delivery” in case of late payment or too high order volume.

Shipping Methods

Here we inform you about the shipping methods and shipping cost of the Whisky4you webshop. We will always do our best to deliver our high quality products in a safe and cost effective way to you. Please note that for the transport and sale of alcoholic beverages, we have to meet also legal regulations. 

If you have any questions or suggestions to the below delivery options, please let us know! 

Shipping methods and cost within Germany (also to packing stations): 

DHL parcel (transport insurance up to 500 Euro):

Basic 3,50 Euro + 0,80 Euro per kg

Prices will be automatically calculated in the shop and paid together with the purchase price. Parcels will be sent to you after payment.

Shipping to Packing Stations:

Are you located near to the German border? We are shipping to the next DHL packing station on your name for the low inland delivery price. 

To most countries you are allowed to import a certain amount of alcohol for private purpose legally without additional taxes or fees

(to many EU countries up to 10 l –  however, please check the actual limits to your country before. We will be happy to assist you.)

If you come for a visit across the border, why not picking up a good bottle from the next parcel shop? 

There are DHL parcel shops also in many smaller towns or villages. Look up for the next one in the parcel shop finder.

Just order in time and your nice bottle will be waiting for you there. For information about the procedure for parcel shop delivery, ask us or find out here.

Shipping methods and cost to other countries:

Orders from individuals of other countries are possible, but cannot be handled automatically in the shop.

To clarify the delivery options, we ask you to send us an email to: info@whisky4you.net.

We will be happy to check for you, if we can sell to your country and what would be the delivery cost for you.

Note about sales and shipment of alcohol:

We would love to offer a direct shipment of our products to all our international customers. Unfortunately, the laws about the sale of alcohol – even within the European Union – are so complicated, go along with such high fees and severe penalties that it is practically impossible for smaller companies to do this.

We tried to do set up legally correct procedures and were prepared to pay correctly our taxes for official imports to other countries.

But a small business, like us, simply can not afford the requirements and the fees that are required for this.

The import into individual countries therefore is reserved for some big wholesalers who have the financial strength and sufficient resources for legal assistance.

In our opinion, this will neither protect the customer from bad alcohol nor will it guarantee the settlement of the state tax debts. But it prevents smaller companies from participating in this market.

Maybe we will – together with you, our customers – once reach the necessary market size. Perhaps also the politicians will care about this problem in the future and at least implement the Europe-wide free trade, which is indeed the aim of the EU.

Until then, unfortunately, we can only offer you the mentioned solutions.

Protection of minors

We take the protection of minors very seriously. We therefore only sell alcoholic beverages to persons of legal age and commercial customers. We ask that you confirm your age when purchasing and will assume that you answer truthfully. Please do not let any minors pick up or receive your parcels.

Terms and Conditions

Scope

For all orders via our online shop by consumers and entrepreneurs, the following terms and conditions apply.

A consumer is any natural person who enters a legal transaction for purposes which are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a legal partnership that, during entering a legal transaction, is acting during its commercial or independent professional activity.

Regarding entrepreneurs, these terms and conditions also apply to future business relationships, without us having to refer to them again. If the entrepreneur uses conflicting or supplementary terms and conditions, its validity is hereby contradicted; they only become part of the contract if we have expressly consented to this.

Contracting party, conclusion of contract

The purchase contract is concluded with Trestan Technology UG (haftungsbeschränkt).

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. You can put our products initially without obligation in the cart and correct your input before submitting your binding order at any time, by providing this in the order process and use explained proofing tools. By clicking on the order button, you place a binding order of the goods contained in the shopping cart. Confirmation of receipt of your order will be made by e-mail immediately after sending the order.

It depends on the payment method you have chosen when the contract is concluded with us:

Payment in advance and payment after shipment

Stripe and Woocommerce are financial service providers that offer various payment options collectively. Your data required for payment is collected, stored, processed and exchanged with your financial services company. After Stripe/Woocommerce has authenticated you as the cardholder, your financial services company will be prompted to initiate the payment process.

In this case, the contract is concluded as soon as you have successfully sent the order with the corresponding payment. You will then immediately receive our order confirmation.

Delivery will be made within 1-3 days once your payment has been credited to our account.

Cash on pickup / Prepayment and pickkup

You can choose to pay cash on pickup at your order. For this option, please click on “Direct bank transfer“ and write into the notes in the order form that you would like to pick up the goods and pay cash on pickup.

Contract language, contract text storage

The language available for the contract is German. We offer an English translation for our English speaking customers, but we do not guarantee its quality. In case of doubt, the German text always applies.

We save the contract text and send you the order data and our terms and conditions by e-mail. The text of the contract is no longer accessible via the Internet for security reasons. The terms and conditions can be found in the link at the bottom of the page (bilingual by switching the language button on the top of the page).

Terms of delivery

In addition to the stated product prices you will also have to pay shipping cost.

You can see in the checkout whether we offer direct shipping to your selected delivery country and at what price. If a notice appears that direct shipping cannot be processed via the shop, please send us an email. We will then clarify for you whether we can ship to your country and under what conditions.

Within Germany, the goods will be shipped immediately after confirmed receipt of payment. The regular delivery time for deliveries from stock is 3 working days from receipt of payment if the goods are in sufficient quantity in stock. You can see this in the item descriptions.

If the entire order is not available in our warehouse, we will backorder the missing goods. As soon as all the ordered goods are available in our warehouse, we ship them to the customer.

If we have a permanent obstacle to delivery, in particular force majeure or non-delivery by our own suppliers, although a corresponding covering transaction has been carried out in good time, for which we are not responsible, we have the right to withdraw from the contract. You will be informed immediately, and services received, in particular payments, will be reimbursed.

If you specify a specific place for delivery and we confirm the order, we are obliged to deliver the goods to the place you specified in the order. Then, according to the purchase contract, you are obliged to accept the goods upon delivery. If you do not accept the delivery or do not pick up the goods within the carrier’s storage time, or if the delivery cannot be delivered due to a lack of labeling on the post office box, we are entitled to charge you a handling fee of €10 (ten euros), plus freight – and to calculate packaging costs.

Exceptions:

When taking over the goods, you are obliged to check the condition of the goods and to complain to the carrier immediately in case of any defects. In the case of a damaged packaging, which shows unauthorized opening of the goods, you are not obliged to take over the shipment from the carrier.

By signing the receipt, you confirm that the goods were taken over properly and undamaged and that no further claims for damage to the goods are asserted.

We also deliver to DHL packing stations and Deutsche Post post offices within Germany. The customer can select the closest station at the following address: https://parcelshopfinder.dhlparcel.com/?setLng=en&countrycode=se    and specify this as the delivery address in the order.

The following information must be entered in the order under “Different shipping address”:

 First and last name

your personal 6-10 digit postal number

the number of the packing station or post office

postcode and

location of the packing station or post office in Germany.

The mentioned rules about overtaking the goods apply also for the pick up. If not picked up within 8 days and the goods are returned to us, we will charge the above-mentioned fee.

The pickup of the goods is possible at our headquarters/shop. The pick-up address of our headquarters/shop is:

Please contact us before the scheduled pickup by email: info@whisky4you.net to arrange the pick up date.

If you arrive without prior agreement, it may be that the pick up is not possible, or the goods are not ready prepared for you. We will not cover any additional cost related to this situation.

 Retention of title

The goods remain our property until full payment.

For entrepreneurs applies in addition: We reserve the ownership of the goods until the complete settlement of all claims from an ongoing business relationship.

You may resell the reserved goods in ordinary business and in compliance with all applicable laws; All claims resulting from this resale shall be assigned to us in advance – irrespective of any combination or mixing of the reserved goods with a new item – up to the invoice amount, and we accept this assignment. You remain entitled to collect the claims, but we may also collect claims by ourselves, as far as you do not meet your payment obligations.

Your claims or rights against us may not be assigned or pledged without our consent unless you have demonstrated a legitimate interest in the assignment or pledge.

 Transport damage

For consumers:

 If goods are delivered with obvious transport damage, please complain about such damages as soon as possible to the transport company and please contact us immediately. The missing complaint or contact has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, they help us assert our own claims against the carrier or transport insurance.

For deliveries to packing stations or parcel shops, we only deliver ExW. This means that the transport risk is transferred from our company to you as soon as the goods are shipped. It is recommended to book a corresponding transport insurance via DHL.

For entrepreneurs:

 The risk of accidental loss and accidental deterioration shall be transferred to you as soon as we have handed over the goods to the freight forwarder, the carrier or the person or institution otherwise responsible for carrying out the shipment. Among traders, the duty to inspect and to reprimand is regulated in § 377 HGB. If you refrain from doing so, the goods are deemed to have been approved, unless they are defects that were not identifiable during the inspection. This does not apply if we have fraudulently concealed a defect.

Warranty and Guarantees

Unless expressly agreed otherwise, the statutory warranty rights apply. For consumers, the limitation period for claims for defects in used goods is one year from delivery of the goods.

For entrepreneurs, the limitation period for warranty claims is one year from the transfer of risk; the statutory limitation periods for the recourse claim under § 478 BGB remain unaffected.

Regarding entrepreneurs, an agreement on the condition of the goods is understood to mean only our own information and the manufacturer’s product descriptions that were included in the contract; We accept no liability for public statements made by the manufacturer or other advertising statements.

If the delivered goods are defective, we initially provide to entrepreneurs at our discretion warranty by rectification of the defect (repair) or by delivery of a defect-free item (replacement).

The above limitations and shortened terms do not apply to claims for damages caused by us, our legal representatives or vicarious agents:

  • In case of injury to life, body, or health
  • in case of intentional or grossly negligent breach of duty as well as malice
  • in the case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations)
  • as part of a guarantee promise, as far as agreed
  • as far as the scope of the product liability law is opened.

Information on any applicable additional guarantees and their exact conditions can be found in the product and on special information pages in the online shop.

The shelf life of food and drinks applies only to unopened packaging and proper storage. An expiration date stated on the packaging limits the guaranteed shelf life to the date indicated.

Liability

We are always liable without limitation for claims due to damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body, or health,
  • in case of intentional or grossly negligent breach of duty,
  • with guarantee promise, if agreed, or
  • as far as the scope of the product liability law is opened.

In case of breach of essential contractual obligations, whose fulfillment enables the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations) by slight negligence on our part, our legal representatives or vicarious agents, the liability shall be limited to the amount foreseeable at the time of conclusion of the contract, which typically must be expected. Incidentally, claims for damages are excluded.

We point out that you buy the alcoholic goods at your own risk and for your own personal use. We also point out that alcoholic beverages are stimulants that can cause dependence and damage to health if consumed excessively. You are solely responsible for the appropriate and responsible handling. We are also not responsible for deciding whether or not you are allowed to consume alcoholic beverages at all. Please ask your doctor if in doubt. We are not responsible for improper use of the products and are not responsible for health risks arising from improper, excessive or any other use of the products by you.

Jurisdiction and Applicable Law

The law of the Federal Republic of Germany is solely applicable. The place of jurisdiction is Neu-Ulm.

This only applies to private consumers if this does not restrict the statutory provisions of the state in which the customer is domiciled or habitually resident. If you are an entrepreneur, German law applies with the exception of the United Nations Convention on Contracts for the International Sale of Goods. If you are a merchant within the meaning of the German Commercial Code, a legal entity

under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is Neu-Ulm.

Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which can be found here http://ec.europa.eu/consumers/odr.

Consumers can use this platform for advice and to resolve their disputes.

To settle disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we do not agree to participate in dispute settlement proceedings before a consumer arbitration board. However, you can always turn to these offices for advice.

Responsible is the agency “General Consumer Arbitration Center of the Center for Arbitration e.V” (Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V.), Straßburger Straße 8, 77694 Kehl am Rhein, http://www.verbraucher-schlichter.de .

Besides of the “Allgemeine Verbraucherschlichtungsstelle” from 01.01.2020 you can also address the Universal Arbitration Center of Germany (Universalschlichtungsstelle des Bundes).

These agencies charges quota-based fees for their services. Therefore, we will not participate in a dispute resolution procedure by these agencies. We are convinced that we will find a good solution on a personal basis with our customers even without these agencies.

 Protection of minors

If your order contains goods that are subject to age restrictions, you will be asked to confirm your age at the time of purchase in the shop. We expressly ask whether you are at least 18 years old and assume a truthful answer.

When personally picking up goods, we determine with an identity and age check that we only hand over the goods to people who are at least 18 years old.

If you have the goods picked up by a private delivery service or have them sent to a packaging station or post office and want to rule out the possibility that underage people take over the goods upon delivery, we recommend adding a personal identity and age check by the transport company for a service fee. If you wish, please contact us before ordering. We will then inform you of the current service charge for the chosen transport service. Please only send a suitable adult to collect such goods.

Final provisions

The invalidity of any provision of these Terms and Conditions has no effect on the validity of the remaining provisions.

These terms and conditions apply from the 16.12.2022 and cancel all previous terms and practices. We reserve the right to change these terms without prior notice.

The data protection declaration of the Trestan Technology UG (haftungsbeschränkt) is based on the terms used by the European legislator for the adoption of the General Data Protection Regulation (GDPR). Our data protection declaration should be legible and understandable for the general public, as well as our customers and business partners. To ensure this, we would like to first explain the terminology used.

In this data protection declaration, we use, amongst others, the following terms:

Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.

2. Right of revocation of contract of the seller

Food and drinks can only be returned in undamaged original packaging including the complete accessories (warranty cards, instructions) and with a copy of the proof of purchase.
